Disparate Impact codification introduced in NYS Legislature

Jumping ahead of any potential Federal action that may weaken the Fair Housing Act of 1968, NY State Senator Brian Kavanagh and Assemblyman Micah Lasher this week introduced new legislation that would codify the Fair Housing Act’s disparate impact standard a key tool in enforcing the Federal Housing Act, and has played a critical role in the development of affordable housing on Long Island.

Most recently, the Village of Garden City was found to be in violation of the Fair Housing Act when they moved to block development of The Florent, a luxury housing development, which has recently become the first multifamily apartment building to open in the Village in over 50 years.
